I. PRIVACY AND DATA PROTECTION POLICY

In accordance with the provisions of the legislation in force, allcosmetics (hereinafter also Website) undertakes to adopt the necessary technical and organizational measures, according to the level of security appropriate to the risk of the data collected.

This Privacy Policy is adapted to current Spanish and European legislation on the protection of personal data on the Internet. Specifically, it complies with the following regulations:

Registration of personal data

In accordance with the provisions of the RGPD and the LOPD-GDD, we inform you that the personal data collected by allcosmetics , through the forms provided on its pages, will be incorporated and processed in our file in order to facilitate, expedite and execute the commitments established between allcosmetics and the User or the maintenance of the relationship established in the forms completed by the User, or to respond to a request or query from the User. Likewise, in accordance with the provisions of the RGPD and the LOPD-GDD, with the exception provided for in Article 30.5 of the RGPD, a register of processing activities is kept which specifies, according to its purposes, the processing activities carried out and the other circumstances established in the RGPD.


Principles applicable to the processing of personal data

The processing of the User’s personal data is subject to the following principles set out in Article 5 of the GDPR and Articles 4 et seq. of Organic Law 3/2018, of 5 December, on the protection of personal data and the guarantee of digital rights:

Categories of personal data

The categories of data processed by allcosmetics are solely identification data. Under no circumstances are special categories of personal data processed within the meaning of Article 9 of the GDPR.

The categories of data processed in allcosmetics are both identification data and special categories of personal data within the meaning of Article 9 of the GDPR.

Special categories of personal data means data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade-union membership, as well as the processing of genetic data, biometric data intended to uniquely identify a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation.

For the processing of particular categories of personal data, the explicit consent of the user for one or more specific purposes is in any case required.
Legal basis for processing personal data

The legal basis for the processing of personal data is consent. allcosmetics undertakes to obtain the explicit and verifiable consent of the user to the processing of his/her personal data for one or more specific purposes.

The user has the right to withdraw consent at any time. It will be as easy to withdraw consent as to give it. As a general rule, withdrawal of consent does not affect use of the website.

In those cases in which users must or may provide their data through forms in order to carry out surveys, request information or for reasons related to the content of the website, they will be informed if the completion of any of these is compulsory because it is essential for the proper performance of the operation carried out.
Purposes of processing personal data

Personal data is collected and managed by allcosmetics in order to facilitate, accelerate and execute the commitments established between the website and the user or to maintain the relationship established in the forms that the user fills out or to respond to a request or consultation.

The data may also be used for commercial, personalisation, operational and statistical purposes, as well as for the extraction and storage of data and marketing studies in order to adapt the content offered to the user and improve the quality, operation and navigation of the website.

At the time the personal data is collected, the user will be informed of the specific purposes for which the personal data will be processed, i.e. the use that will be made of the information collected.

Retention period for personal data

Personal data will only be kept for the minimum period necessary for the purposes of its processing and, in any event, for the following period: 18 years, or until the user requests its deletion.

Personal data of minors

In accordance with the provisions of Article 8 of the GDPR and Article 7 of Organic Law 3/2018 of 5 December 2018 on the protection of personal data and the protection of digital rights, only persons over the age of 14 may give their consent to the lawful processing of their personal data by allcosmetics. In the case of children under the age of 14, the consent of their parents or guardians is required for processing, which is lawful only to the extent that the parents or guardians have given their consent.
Secrecy and security of personal data
allcosmetics undertakes to adopt the necessary technical and organizational measures, according to the level of security appropriate to the risk of the data collected, in order to ensure the security of personal data and to prevent the accidental or unlawful destruction, loss or alteration of personal data transmitted, stored or otherwise processed, as well as unauthorized disclosure or access to such data.
The website is SSL (Secure Socket Layer) certified, which guarantees that personal data are transmitted securely and confidentially, since the transmission of data between the server and the user, and in return, is fully encrypted or coded.

However, as allcosmetics cannot guarantee the impregnability of the Internet or the total absence of hackers or other persons fraudulently accessing personal data, the Data Controller undertakes to notify the User, as soon as possible, of any breach of security of personal data likely to result in a high risk to the rights and freedoms of natural persons. In accordance with Article 4 of the GDPR, a breach of security of personal data is any breach of security resulting in the accidental or unlawful destruction, loss or alteration of personal data transmitted, stored or otherwise processed, or in the unauthorised disclosure of or access to such data.

Personal data is treated as confidential by the data controller, who undertakes to inform and ensure, by means of a legal or contractual obligation, that this confidentiality is respected by its employees, partners and any person to whom it makes the information accessible.
Rights arising from the processing of personal data

The User has on allcosmetics and may, therefore, exercise against the Data Controller the following rights recognized by the RGPD and Organic Law 3/2018, of 5 December, on the protection of personal data and the guarantee of digital rights:

Right of access: this is the user’s right to obtain confirmation as to whether or not allcosmetics is processing their personal data and, where applicable, to obtain information on their specific personal data and on the processing that allcosmetics has carried out or is carrying out, as well as, among other things, the information available on the origin of such data and the recipients of the communications carried out or planned for such data.

Right of rectification: This is the user’s right to have his or her personal data amended if it proves to be inaccurate or, given the purposes of the processing, incomplete.
Right to erasure (‘right to be forgotten’): This is the user’s right, unless otherwise provided by law, to have their personal data erased when it is no longer necessary for the purposes for which it was collected or processed; the user has withdrawn their consent to the processing and there is no other legal basis for the processing; the user objects to the processing and there is no other legitimate reason for continuing the processing; the personal data has been processed unlawfully; the personal data must be erased by virtue of a legal obligation; or the personal data has been obtained as a result of a direct offer of information society services to a person under the age of 14. In addition to erasing data, the data controller shall erase personal data taking into account the technology available and the cost of processing.

Right to restrict processing: this is the user’s right to restrict the processing of their personal data. The user has the right to obtain the limitation of processing when he disputes the accuracy of his personal data; the processing is unlawful; the controller no longer needs the personal data, but the user needs it to make claims; and when the user has objected to the processing. Right to data portability: Where processing is carried out by automated means, the user has the right to receive his or her personal data from the controller in a structured, commonly used and machine-readable format and to transmit it to another controller. Where technically possible, the data controller will transmit the data directly to the other data controller. Right to object: This is the user’s right not to have his/her personal data processed or to stop the processing of such data by allcosmetics. Right not to be subject to a decision based exclusively on automated processing, including profiling: this is the user’s right not to be subject to an individualised decision based exclusively on automated processing of his/her personal data, including profiling, unless otherwise provided by law.

Therefore, the user may exercise his/her rights by means of a written communication addressed to the data controller with the reference ‘RGPD-https://allcosmetics.uk’, specifying:

Name, surname(s) of the user and a copy of the user’s National Identity Document (DNI). In cases where representation is authorised, it will also be necessary to identify the person representing the User by the same means, as well as the document accrediting the representation. The photocopy of the DNI may be replaced by any other legally valid means that accredits the identity. Request with the specific reasons for the request or the information to which access is requested. Address for notification purposes. Date and signature of the applicant. Any document that substantiates the request.

The Website may contain hyperlinks or links to websites of third parties other than allcosmetics, which are not operated by allcosmetics. The owners of these websites have their own data protection policies and are themselves, in each case, responsible for their own files and privacy practices.
Complaints to the supervisory authority

If the user considers that the processing of his/her personal data poses a problem or infringes the regulations in force, he/she has the right to effective judicial protection and to lodge a complaint with a supervisory authority, in particular in the State in which he/she has his/her habitual residence, place of work or the place of the alleged infringement. II. ACCEPTANCE AND MODIFICATION OF THIS PRIVACY POLICY

It is necessary for the user to have read and accepted the conditions relating to the protection of personal data contained in this privacy policy, and to agree to the processing of his/her personal data so that the data controller can proceed in the manner, during the periods and for the purposes indicated. The use of the website implies the acceptance of the privacy policy of the website.

allcosmetics reserves the right to modify its Privacy Policy, according to its own criteria, or motivated by a change in legislation, jurisprudence or doctrine of the Spanish Agency for Data Protection. Changes or updates to this Privacy Policy will not be explicitly notified to the user. The user is advised to consult this page regularly to keep abreast of the latest modifications or updates.
